QUICKSILVER MASTER RENTAL AGREEMENT

Terms and Conditions

The following Quicksilver Master Rental Agreement sets forth the terms and conditions applicable to every rental of a private passenger motor vehicle through the Quicksilver program. This Agreement is divided into the following three sections: (I) Terms and Conditions applicable to all rentals; (II) Important information about Alamo's optional products, including information on terms, conditions, and charges regarding products selected; and (III) other important information. Please read all sections carefully, all of which collectively constitute the Agreement and which may also be referred to as Quicksilver.

I. Terms and Conditions

The terms and conditions set forth below constitute an agreement for the rental of private passenger motor vehicles ("car", "cars") using Quicksilver service unless otherwise indicated herein, 'I', 'me', 'my', refers to the person(s), companies, or business entities who sign this Agreement. 'You,' 'You', 'us' refers to Alamo Rent-A-Car, L.L.C. The Rental Agreement is a written confirmation of the individual rental with the charges and other parameters of each particular rental, as well as the identity of the Alamo location from which I am renting. I will either receive the Rental Agreement prior to the start of each rental made through Quicksilver or sign the Rental Agreement at the Alamo rental location each time I rent through Quicksilver. I understand and agree that the terms listed herein will apply each time I rent a car through Quicksilver. I understand and agree that you may change these terms at any time upon notice to me, either in writing or through display on a Quicksilver Kiosk screen. I may change my selection of optional products by either sending you a new enrollment form or, for a particular rental only, by proceeding through a standard counter transaction with a separately signed Rental Agreement prior to picking up the car.

1. PICKING UP AND RETURNING THE VEHICLE: I acknowledge that choosing to leave an Alamo rental facility in a car pursuant to Quicksilver constitutes an acknowledgment that the car is in overall good condition and has no apparent defects. I agree to return the car in the same condition. I may inspect the car as long as I like before leaving the rental facility. I will return the car to the designated Alamo office on the date and time specified in the Rental Agreement, or sooner if you demand. I will pay all your charges, losses, and expenses if I fail to do so. All notices will be sent to me at the latest address on file, and I acknowledge that such address is correct.

2. RENTAL CHARGES: I will pay the rental rate, taxes, and other charges shown on the Rental Agreement under the conditions set out herein. The minimum charge is one (1) day (24 hours). Additional hours are charged at one-third of the daily rate. I will pay all taxes, airport fees, surcharges, and additional charges which may apply to the rental. Early return of a weekly rental may convert my rental rate to the daily rate charge shown on the front of the Rental Agreement. An additional fee may be charged if I return a car to a location other than where it was rented or return it to a location other than the one stated in the Rental Agreement.

3. PROHIBITED USES AND VIOLATIONS: THE FOLLOWING USES OF THE CAR ARE STRICTLY PROHIBITED. THE CAR CANNOT BE USED: a) To carry people or property for hire; b) for any illegal purpose; c) in any speed contest or race; d) if the driver is under the influence of alcohol, drugs, or intoxicants; e) if obtained by fraud or misrepresentation; f) if the driver is anyone other than an Alamo Authorized Driver as defined in the Rental Agreement; g) to intentionally cause bodily injury or property damage; h) to tow or push anything; i) to drive outside of the United States or Canada; j) in Canada, to drive off roads maintained by municipal, provincial, and federal authorities, or elsewhere, to drive off paved roads; k) in violation of its designed passenger or cargo capacity. Further, leaving the car and failing to remove the keys from ignition is a violation.

4. RESERVATIONS: I agree to make each Quicksilver reservation at least twenty-four (24) hours in advance, and to advise the reservation agent that this will be a Quicksilver rental.

5. LOSS OR DAMAGE TO THE VEHICLE: I will pay you for all damage to or loss of the car, including your loss of use and administrative fees, regardless of who is at fault. Any limitation of my responsibility must be stated in the Rental Agreement. If you elect not to repair the car, I will pay you the retail value of the car before it was damaged, less any amount you get for salvage.

6. OPTIONAL COLLISION DAMAGE WAIVER (CDW): If purchased, CDW waives all or part of my responsibility for damage to or loss of the car, depending on the waiver plan chosen. CDW is optional, and is not insurance. CDW is not required to rent a car. If I decline CDW, I will pay for all damage to or loss of the car. If I accept CDW by so indicating on the Master Rental Agreement Profile, then I will receive and pay for CDW for each Quicksilver rental. I understand that the CDW option may not be available in some locations pursuant to state, provincial, or local law and that in those locations, I will not receive CDW and will be liable for loss of or damage to the car to the full extent allowed by law. For rentals in California, Nevada, Illinois, or Wisconsin, if I selected Waiver Saver 500 or 3000, I will receive Maxi Waiver Saver at the price used by Alamo at that location for that product. I understand that I may change my decision to take CDW on future rentals by sending you a new enrollment form or, for a particular rental only, by proceeding through a standard counter transaction with a separately signed Rental Agreement prior to picking up so that CDW may be deleted from that particular rental. If I accept CDW, a statement on the Rental Agreement will describe the plan and my financial responsibility. I UNDERSTAND AND AGREE THAT CDW IS VOID AND IS NOT IN EFFECT IF LOSS OR DAMAGE OCCURS DURING ANY OF THE Prohibited Uses LISTED ABOVE IN SECTION 3. CDW does not waive my responsibility for the cost of any equipment (including, for example, tires, wheels, seats) not returned with the car, unless approved by an Alamo manager in writing. Regardless of whether I purchase CDW or not, I will promptly report any accident or theft to your nearest office. I understand that you may change the price of CDW at any time and that I may learn the charge for the particular optional product for my rental by asking the reservation agent when I reserve the car.

ADDITIONAL NOTICES ABOUT COLLISION DAMAGE WAIVER, FINANCIAL RESPONSIBILITY FOR RENTALS AND OTHER LEGAL ISSUES IN THE FOLLOWING STATES. For purposes of these notices, the definitions of 'I', 'me', 'my', 'you', and 'your', change as indicated. My signature on the Alamo Quicksilver Enrollment Form constitutes my acknowledgement that I have read and understood each of the following notices:

ARIZONA

CALIFORNIA AND NEVADA
('You' and 'your', refer to the person(s) who sign this Agreement.) You are responsible for loss of or damage to the rented vehicle even if someone else is at fault or the cause is unknown. You are responsible for the cost of repair up to the value of the vehicle, loss of use and towing, storage, administrative fees, and impound fees. Your own insurance may cover all or part of your financial responsibility for the rental vehicle. You should check with your insurance company to find out about your coverage. Alamo will not hold you responsible if you buy CDW. But, CDW is void and Alamo will hold you financially responsible if: (1) Loss or damage occurs because you or an authorized driver intentionally caused the loss or damage, or were impaired due to alcohol or drugs; or (2) Loss or damage occurs while the vehicle was being driven by an unauthorized driver or you used the vehicle to carry people or property for hire; or you used the vehicle in the commission of a crime; or you used the vehicle in a speed contest; or you used the vehicle to tow or push anything; or you used the vehicle to drive into Mexico. The cost of optional CDW is US$9 per day in California and US$9.99 per day in Nevada. Nevada law requires any driver of a passenger car and any passenger 5 years of age or older who rides in the front or back seat of a passenger car to wear a safety belt if one is available for his seating position.

I understand I will still be responsible for all damage to or loss of the vehicle if: (1) I or an authorized driver intentionally caused the damage or loss or was impaired due to alcohol or drugs; or (2) The vehicle was being driven by an unauthorized driver; or (3) The vehicle was used to carry people or property for hire; or (4) The vehicle was used in the commission of a crime, in a speed contest or to push or tow anything. Further, I will be responsible for all damage or loss in excess of (a) US$500 if I purchased WAIVER SAVER 500; or (b) US$3,000 if I purchased WAIVER SAVER 3000. MARYLAND
IN THE FOLLOWING SECTION, THE WORDS 'YOU' AND 'YOUR', REFER TO THE PERSON(S) WHO RENT THE CAR FROM ALAMO, ANY AUTHORIZED DRIVER(S) (AS DEFINED UNDER THE TERMS AND CONDITIONS OF THE ALAMO RENTAL AGREEMENT), OR THEIR INSURER(S).

PLEASE READ BEFORE SIGNING THE MASTER RENTAL AGREEMENT PROFILE. UNLESS INCLUDED IN YOUR RATE, THERE IS AN ADDITIONAL CHARGE FOR COLLISION DAMAGE WAIVER (CDW). CDW WILL ONLY COVER YOUR LIABILITY FOR SOME OR ALL DAMAGE TO THE RENTAL CAR ITSELF. PERSONAL INJURIES OR OTHER LOSSES ARE NOT COVERED. BEFORE YOU AGREE TO PAY FOR COLLISION DAMAGE WAIVER, YOU SHOULD KNOW THAT: 1) YOU PROBABLY DO NOT NEED CDW IF YOU RESIDE IN MARYLAND AND HAVE AN AUTOMOBILE INSURANCE POLICY WITH COLLISION COVERAGE, SINCE YOUR COLLISION COVERAGE IS REQUIRED BY LAW TO ALSO COVER PASSENGER CARS YOU RENT FOR 30 DAYS OR LESS. YOUR OWN POLICY, FOR MARYLAND RESIDENTS AND NON-RESIDENTS, MAY PROVIDE GREATER COVERAGE FOR LONGER PERIODS. IF YOU RENT THE CAR WITH A CREDIT CARD, YOUR CREDIT CARD MAY PROVIDE COVERAGE FOR DAMAGE TO THE RENTAL CAR. 2) EVEN IF YOU BUY CDW IT MAY NOT COVER ALL TYPES OF DAMAGE TO A RENTAL CAR, AND CDW HAS IMPORTANT CONDITIONS, RESTRICTIONS AND EXCLUSIONS, WHICH IF VIOLATED, MAY VOID THE WAIVER. 3) YOU DO NOT HAVE TO PURCHASE CDW, YOU CAN DECLINE IT.

SUMMARY OF TERMS AND CONDITIONS OF THE CDW BEING OFFERED TO YOU: 1) COST: ALAMO OFFERS THREE CDW OPTIONS FOR A CHARGE IN ADDITION TO THE RENTAL CHARGE ITSELF: MAXI WAIVER SAVER, AT A COST OF US$16.99 PER DAY, WAIVES YOUR RESPONSIBILITY FOR ALL LOSS OR DAMAGE TO THE RENTAL CAR REGARDLESS OF AMOUNT; WAIVER SAVER 3000, AT A COST OF US$7.99 PER DAY, WAIVES YOUR RESPONSIBILITY FOR UP TO THE FIRST US$3,000 OF LOSS OR DAMAGE TO THE RENTAL CAR. YOU ARE RESPONSIBLE FOR ALL LOSS OR DAMAGE WHICH EXCEEDS US$3,000; WAIVER SAVER 500, AT A COST OF US$4.99 PER DAY, WAIVES YOUR RESPONSIBILITY FOR UP TO THE FIRST US$500 OF LOSS OR DAMAGE TO THE RENTAL CAR. YOU ARE RESPONSIBLE FOR ALL LOSS OR DAMAGE WHICH EXCEEDS US$500. THE COST OF CDW IS SUBJECT TO CHANGE. YOU WILL BE NOTIFIED OF ANY CHANGE IN THE COST OF CDW PRIOR TO RENTAL. 2) TYPES OF DAMAGE FOR WHICH YOU ARE LEGALLY RESPONSIBLE IF YOU PURCHASE CDW: THE CAR RENTAL AGREEMENT REQUIRES YOU TO ACCEPT RESPONSIBILITY FOR ALL DAMAGES OR LOSS TO THE RENTAL CAR. IF YOU PURCHASE CDW, AND COMPLY FULLY WITH THE TERMS OF THE RENTAL AGREEMENT, YOUR RESPONSIBILITY IS LIMITED TO THE AMOUNTS STATED ABOVE DEPENDING UPON WHICH OPTION YOU PURCHASED. 3) CONDITIONS, RESTRICTIONS, AND EXCLUSIONS WHICH WILL VOID CDW: EVEN IF YOU PURCHASED CDW, IT WILL BE VOIDED AND YOU WILL BE RESPONSIBLE FOR THE FULL VALUE OF ANY LOSS OR DAMAGE TO THE RENTAL CAR IF: (A) THE CAR WAS BEING DRIVEN BY AN UNAUTHORIZED DRIVER; (B) THE RENTER OR DRIVER INTENTIONALLY CAUSED THE LOSS, DAMAGE, OR THEFT; (C) THE CAR WAS BEING DRIVEN WHILE UNDER THE INFLUENCE OF ALCOHOL OR DRUGS; (D) THE CAR WAS USED FOR HIRE; (E) THE CAR WAS USED IN THE COMMISSION OF A CRIME OR FOR AN ILLEGAL PURPOSE; THE CAR WAS DRIVEN OFF PAVED ROADS; (F) THE CAR WAS DRIVEN IN A SPEED CONTEST OR RACE; (G) THE CAR WAS USED TO TOW OR PUSH ANYTHING; (H) THE CAR WAS DRIVEN INTO MEXICO ; (I) THE CAR WAS OBTAINED THROUGH FRAUD OR MISREPRESENTATION; (J) THE IGNITION KEY WAS LEFT IN THE CAR AND THE CAR WAS STOLEN; (K) THE CAR WAS USED IN VIOLATION OF ITS DESIGNED PASSENGER OR CARGO CAPACITY; OR (L) IF ANY ACCIDENT, DAMAGE OR THEFT WAS NOT PROMPTLY REPORTED TO ALAMO.>

MISSOURI
('You' and 'your', refer to the person(s) who sign this Agreement.) Notice: This contract offers, for an additional charge, a collision damage waiver to cover your responsibility for damage to the vehicle. Before you decide whether to purchase the collision damage waiver product, you may wish to determine whether your own vehicle insurance affords you coverage for damage to the rental vehicle and the amount of the deductible under your own insurance coverage. The purchase of this collision damage waiver product is not mandatory and may be declined.

LOUISIANA
('You' and 'your', refer to the person(s) who sign this Agreement.) Notice: If you have collision coverage under your own automobile insurance policy written in Louisiana, your collision coverage automatically extends to rental motor vehicles pursuant to R.S. 22:1406 (f). Even if you are not Louisiana insured, the purchase of collision damage waiver is not mandatory and may be waived. This contract offers, for an additional charge, a collision damage waiver to cover your responsibility for damage to the vehicle. Before deciding whether to purchase the collision damage waiver, you may wish to determine whether your own automobile insurance affords you coverage for damage to the rental vehicle and the amount of the deductible under such coverage.

MASSACHUSETTS
('You' and 'your', refer to the person(s) who sign this Agreement.) Notice: This contract offers, for an additional charge, a collision damage waiver to cover your financial responsibility for damage to the rental vehicle. Your personal automobile insurance may already cover you for damage to a rental car. The purchase of a collision damage waiver is optional and may be declined. For Massachusetts's drivers: if you have an automobile policy on your personal vehicle with coverage for collision, your policy will cover collision damage to a rental vehicle, less the deductible on your policy. Drivers who hold policies in other states should check with their insurance agents to determine whether their policies extend to rental vehicles.

TEXAS
1.The Texas personal automobile insurance policy provides coverage for the legal liabilities of the policyholder in connection with the loss of or damage to a rented vehicle except for damages caused intentionally. Therefore, it may not be necessary for the renter to purchase the Loss Damage Waiver (collision damage waiver).
2. The purchase of a Loss Damage Waiver (Collision Damage Waiver) is not mandatory.
3. The Loss Damage Waiver (Collision Damage Waiver) is not insurance coverage.

MINNESOTA
Under Minnesota law, a personal automobile insurance policy issued in Minnesota must cover the rental of this motor vehicle against damage to the vehicle and against loss of or use of the vehicle. Therefore, purchase of any collision damage waiver or similar insurance effected in this rental contract is not necessary if your policy was issued in Minnesota.

NEW MEXICO AND TENNESSEE
Notice: the renter may already be covered for liability and for loss of or damage to the rental vehicle under his personal motor vehicle insurance policy. If such coverage exists and is confirmed, the renter may require Alamo to submit any claims to the renter's personal insurance carrier as the renter's agent.

7. OTHER OPTIONAL INSURANCE/PRODUCTS: Carefree Personal Protection, Extended Protection (EP), Alamo Protection Plus (APP), and other such options are offered within the states where permitted. I understand that the details set forth below pertaining to the availability and information on the optional products applies to me, the particulars of which are described and limited in the section of this Agreement entitled "Important Information About Our Optional Products" and in any underlying policy. I understand that if I choose any of these options by so indicating herein, I will pay for those options on each rental that I make under Quicksilver and that I may be charged the full daily rates even if I do not have the car a full day. However, I may change my selection of these options for future rentals by sending you a new enrollment form or, for a particular rental only, by proceeding through a standard counter transaction with a separately signed Rental Agreement. I understand that any optional insurance is void and ineffective if at the time of the accident or loss, the car was used in and/or subjected to any of the Prohibited Uses listed above in Section 3. I understand that you may change the price of any of these options at any time and that I may learn of the charge for a particular option for my rental by asking the reservation agent when I reserve the car.
LIABILITY INSURANCE: UNLESS CONTRARY TO STATE LAW OR OTHERWISE PROVIDED IN MY EMPLOYER'S ALAMO CORPORATE RATE AGREEMENT AND I AM RENTING PURSUANT TO THAT AGREEMENT, IF THERE IS NO OTHER VALID AND COLLECTIBLE INSURANCE, WHETHER PRIMARY, EXCESS OR CONTINGENT, AVAILABLE TO THE RENTER (OR TO ANY AUTHORIZED DRIVER WHILE OPERATING THE CAR) SUFFICIENT TO MEET MINIMUM FINANCIAL RESPONSIBILITY LAW REQUIREMENTS, THEN, IN ALL STATES, PROVINCES, AND/OR COUNTRIES EXCEPT CALIFORNIA, ALAMO SHALL PROVIDE PROTECTION AGAINST LIABILITY FOR BODILY INJURY, DEATH OR PROPERTY DAMAGE TO OTHERS UP TO THE MINIMUM FINANCIAL RESPONSIBILITY LIMITS REQUIRED BY APPLICABLE LAW. SUCH PROTECTION SHALL BE PROVIDED THROUGH EITHER AN INSURANCE POLICY OR A CERTIFICATE OF SELF INSURANCE (IF PROVIDED, YOU HAVE NO DUTY TO DEFEND AFTER TENDERING MINIMUM LIMITS). I AGREE THAT ANY AMOUNTS OVER THIS MINIMUM WILL BE COVERED BY ME OR BY MY LIABILITY POLICY AND I WILL INDEMNIFY YOU AND YOUR INSURER FOR ANY LOSSES THAT EXCEED THE MINIMUM LIMITS. I MAY SEE A COPY OF YOUR POLICY OR SELF-INSURANCE CERTIFICATE AT YOUR RENTAL OFFICE. ALL TERMS AND CONDITIONS OF THE POLICY OR CERTIFICATE ARE INCORPORATED INTO THIS AGREEMENT. ANY OTHER COVERAGE OR BENEFITS (SUCH AS, FOR EXAMPLE, BASIC NO-FAULT) ARE PROVIDED ONLY IF (A) REQUIRED BY STATE OR PROVINCIAL LAW AND (B) THERE IS NO OTHER VALID AND COLLECTIBLE INSURANCE AVAILABLE; AND THEN ONLY UP TO STATE-REQUIRED MINIMUM LIMITS. YOU PROVIDE NO COVERAGE WHATSOEVER TO UNAUTHORIZED DRIVERS. THERE IS NO BODILY INJURY LIABILITY COVERAGE FOR CLAIMS BETWEEN ME AND ANY MEMBER OF MY FAMILY RESIDING IN THE SAME HOUSEHOLD AS ME. IN CALIFORNIA, STATE LAW REQUIRES DRIVERS TO MEET STATE FINANCIAL RESPONSIBILITY REQUIREMENTS. ALAMO PROVIDES NO LIABILITY PROTECTION ON CALIFORNIA RENTALS (PERSONAL AUTO LIABILITY POLICIES MAY OR MAY NOT PROVIDE COVERAGE). THERE IS NO COVERAGE IN MEXICO IF I RENT FROM A U.S. OR CANADIAN LOCATION, TO THE EXTENT PERMITTED BY LAW.

NOTICE PURSUANT TO FLORIDA LAW: "THE VALID AND COLLECTIBLE LIABILITY INSURANCE AND PERSONAL INJURY PROTECTION INSURANCE OF ANY AUTHORIZED RENTAL OR LEASING DRIVER IS PRIMARY FOR THE LIMITS OF LIABILITY AND PERSONAL INJURY PROTECTION COVERAGE REQUIRED BY SS. 324.021(7) AND 627.736, Florida Statutes'. I REMAIN LIABLE FOR ALL CLAIMS IN EXCESS OF SAID LIMITS OF LIABILITY UNDER THE TERMS OF THE LIABILITY INSURANCE SECTION AS SET FORTH ABOVE.

8. AUTHORIZED DRIVERS: I am the authorized driver if I have a valid driver's license and meet all of your rental requirements. I and the following persons, with my permission, may operate the car: (1) my spouse; or (2) my employer, or fellow employees incidental to their business duties, provided the persons have a valid driver's license and meet all of your rental requirements and are not impaired from operating the rental car. Except to the extent necessary for valet parking or in an emergency as permitted by law, no other persons are permitted to operate the car unless all such persons appear at the time of rental and are named on the Rental Agreement. I understand that all additional drivers must be at least twenty-one (21) years of age except in New York (18), and have a valid driver's license. At our discretion, other qualifications may be in effect at the time and place of rental, which may include a charge for any additional driver or any driver under twenty-five (25) years of age. ALL OTHER DRIVERS ARE UNAUTHORIZED. Not withstanding anything herein, I am always responsible for any losses or damages caused by any driver of the rental car.

9. FINES AND EXPENSES: I am responsible for and will promptly pay for any parking fines, traffic violations (moving or stationary) and related costs committed or incurred during the rental. If you have to pay any such fine, I agree to reimburse you, together with a reasonable administrative fee, if any, and I authorize you to charge my credit card for such fines, costs, and fees.

10. COLLECTIONS: All charges, fees, and expenses (including payment for loss of or damage to the car) are due at your request and, where permissible, I assign to you any and all proceeds from coverage under credit card plans or other insurance. I agree to pay interest of one and one-half percent (1.5%) per month on all past due balances. For any amounts not paid when due, I will pay any collection costs and reasonable attorneys' fees, including appeals. You may contact me in my place of business in connection with your collections.

11. CREDIT CARD CHARGES: By signing this Agreement, I authorize you to charge my credit card for the charges evidenced in the Rental Agreement, for any additional charges upon return of the car, and for any parking or traffic-related fines. If I am overcharged or undercharged, you may credit or charge my card.

12. PROPERTY LEFT IN YOUR POSSESSION: I understand Alamo will not be responsible for loss or damage to any property left in or on the car, Alamo's premises, or service vehicle.

13. LAWSUITS:
a) I acknowledge entering into the rental transaction, pursuant to the terms of this Agreement. Accordingly, I accept and acknowledge by the execution of this Agreement that I may only bring a lawsuit connected to a rental transaction against the Alamo company identified in the related Rental Agreement. Furthermore, I acknowledge that the county/city within the state/province/country where the rental transaction originated is the only place where I may file any such legal action. For rentals by companies or businesses or their employees, and without prejudice to you for any other situations, I acknowledge that you may file a lawsuit against me either in the courts where the company named on the Rental Agreement has its headquarters or in the courts where I have my residence, at your discretion.
b) I accept and acknowledge that if I bring a lawsuit against you or if you sue me, then the law of the county/city within the state/province/country in which the rental was originated shall apply to and control over any issues regarding this Agreement.
c) I agree to pay your reasonable attorneys' fees and costs in any lawsuit relating to this Agreement or a rental transaction, including appeals. d) You shall not be responsible for special, indirect, or consequential damages or for other liability unless caused by your gross negligence or willful misconduct.

14. VOID TERMS: If the laws of the state/province/jurisdiction of rental change, limit or prohibit any part of this Agreement (such as, for example, CDW, authorized drivers, or damage losses allowed), then those parts shall be void and the applicable law shall control, but the remainder of this Agreement shall remain in full force and effect.

15. OPTIONAL SERVICES: After reading this Agreement, I will select the optional Alamo customer services I wish to purchase wherever available when using Quicksilver. I will initial only the appropriate spaces. (I must initial either 'yes' or 'no' for each optional item listed.)

II. Important information about our optional products

(For the purposes of this section, 'You' and 'your', refer to the persons, companies, or business entities who sign this Agreement.) Described below are the optional products you may purchase. ALAMO OFFERS NO FULL COVERAGE PRODUCT. The benefits provided by any optional product, if purchased by you, are only as described herein, and in the underlying insurance policy, if any. No rental agent or other Alamo employee may vary any of the terms or conditions of any optional product or this Agreement. The purchase of any of the following optional products is entirely optional; you are not required to purchase or elect any of them in order to rent our cars.

16. COLLISION DAMAGE WAIVER (CDW) - CDW is not insurance. The purchase of optional CDW contractually waives or limits your personal responsibility to Alamo for damage to or loss of its rental car, regardless of fault, unless you or an authorized driver intentionally caused the damage or loss or were impaired due to alcohol, drugs, or intoxicants, or the damage or loss occurred when the car was being driven by an unauthorized driver. In addition, if you violate any of the terms of the Rental Agreement, or engage in any of the Prohibited Uses, as described in Section 3, any CDW benefits become void and of no force or effect. The laws of the county, state, or province in which you are renting may limit the reasons for voiding CDW or the sale of CDW. At most locations, Alamo offers three different levels of CDW protection, which are called Waiver Savers and are described immediately below. III. Other Important Information

NOTICE CONCERNING OTHER INSURANCE COVERAGE YOU MAY HAVE: The election of any of the protection or coverage described in this Agreement may duplicate, void, or cause your own policies to become excess coverage. Your own auto policy or credit card may provide rental car damage or loss coverage. Alamo personnel cannot interpret them or advise you on what they may or may not cover. The purchase of CDW may void or limit other coverage that you may have under a credit card or personal auto policy. If you elect APP, PAI, PEC, PAEC, or PersPro, various credit card insurance death benefits could become excess insurance coverage, meaning that any benefits due are available only if the amount sought in a claim exceeds the policy limits of any other applicable insurance obtained by cardholders, or those benefits could become void.

AIRPORT-IMPOSED FEES. Many airports impose a fee for off-airport rental car transactions which applies if the customer exits the airport using the off-airport company's shuttle bus. In airports where this applies, we pass this fee through to our customers as an additional charge. The amount of the fee varies by airport. If such a fee is imposed, this charge will appear as a separate item entitled "Arpt. Fee" in the pre-calculation of charges set forth in your Rental Agreement.

AVAILABILITY OF PROTECTION/COVERAGE DESCRIBED. Federal, state, or local laws may limit or vary the terms and conditions of the protection/coverage described, or may prohibit them entirely. Thus, some of these options may not be available in the particular state or location in which you are renting. Any offer as described in this Agreement is void if prohibited by law. In some states and countries, Alamo may be a qualified self-insurer for certain coverage options.

HOW TO MAKE A CLAIM. All claims under optional EP, APP, PAI, PEC, or PAEC must be made on Alamo's claim forms within ninety (90) days of the incident or accident giving rise to the claim. If the claim is for personal injuries, you must also obtain and submit itemized medical expense statements. If the claim is for personal effects, you must also obtain and submit a police report. In addition, you must call Alamo to report the incident or accident as soon as possible. You may call either the Alamo location at which you rented the car or the location nearest you. Your failure to report a claim promptly, or within 90 days of the incident or accident giving rise to the claim, may result in a denial of benefits. Forms are available through the claims representatives. For auto liability claims only, call the nearest Alamo rental facility. Please call the toll-free number for your area if you need to confirm the name of the insurance carrier or policy number.

PROOF OF COVERAGE. Your proof of coverage under any optional product is your Rental Agreement. The optional coverage abbreviation will appear on the face of the Rental Agreement in computer-generated print. You should save your copy of the Rental Agreement. However, in case you lose it, Alamo will provide a copy on upon request.

YOUR RESPONSIBILITIES IN AN ACCIDENT. You must ensure that the police are called to the accident scene and that you request a copy of the police report. You should record the name of the officer(s) and the city, county, state, or provincial law enforcement unit to which they are assigned. Further, you must cooperate with counsel representing Alamo in defending a claim by other parties and make yourself available for sworn statements, depositions and trial. You must also keep Alamo informed as to your current address and phone number during the pendency of the claim.

SALES TAX AND OTHER GOVERNMENTAL CHARGES. In addition to General Services Taxes, and state or local sales or excise taxes, which vary in amount from state to state, some countries, states, counties, cities, and other local governmental authorities impose or authorize surcharges, fees, or additional taxes on car rental transactions. The amount may be in the form of a percentage of the rental charges or a flat, fixed sum. Alamo collects and remits these charges to the appropriate governmental bodies which impose them. These items are set forth in the pre-calculation of charges on your Rental Agreement.

RENTAL PERIOD AND EXTENSIONS. Your rental period and return date are as shown on the face of the Rental Agreement provided to you when you pick up your car. If you wish to extend the rental period beyond the return date shown, you must go to an Alamo rental facility and obtain a new Rental Agreement. Extensions are not automatic and may be refused by Alamo at its sole discretion. In addition, any extension is subject to availability. Failure to obtain a new Rental Agreement to replace an expired Rental Agreement may cause Alamo to request the police to issue a warrant for the car and subject you to arrest, prosecution, and to civil and criminal penalties.

SEAT BELTS AND CHILD SAFETY SEATS. Federal and state laws require the use of seat belts and approved child safety seats. Please refer and adhere to applicable laws and manufacturers' recommendations concerning the use of seat belts and child safety seats. SEAT BELTS AND CHILD SAFETY SEATS CAN SAVE LIVES. We urge you to use them. To avoid serious injury or death, in accordance with manufacturers' warnings, only use child safety seats in the back seat of the car. All children under the age of thirteen (13) (whether in safety seat or not) should ride properly buckled up in the back seat.
